THE CHARTER TOWNSHIP OF CHESTERFIELD
PLANNING COMMISSION
OCTOBER 11, 2011

A regular meeting of the Charter Township of Chesterfield Planning Commission was held on Tuesday, October 11, 2011 at 7:00 p.m. at the Township Hall located at 47275 Sugarbush, Chesterfield MI 48047.

1. CALL TO ORDER:

Chairman Miller called the meeting to order at 7:00 p.m.

3. APPROVAL OF THE AGENDA:

Motion by Mr. Miller, supported by Mr. DeMuynck to approve the agenda as presented.

4. SUBCOMMITTEE REPORT: (Committee will report items under Reviews)

5. PUBLIC HEARING:

A. PROPOSED NEW GARAGE ON A CANAL LOT – SLU #2011-05: Joseph Sowerby, 48264 Harbor Drive, Chesterfield, MI 48047. Proposed new garage on a canal lot location is across from the above address. Public Hearing set on September 13, 2011.

Motion by Mr. Miller, supported by Mr. Stabile to open the Public Hearing on Proposed New Garage on a Canal Lot – Special Land Use #2011-05 at 7:23 p.m.

All Ayes Motion Carried

The petitioner, Joe Sowerby, clarified that he would be building the garage on a lot directly adjacent to a residence that he has lived in for over 20 years. This garage would be on the canal side as opposed to the lake side of Harbor Drive. Mr. Sowerby said that he has agreed to everything discussed with the engineers and he has obtained letters signed by neighbors consenting to the project. Mr. Sowerby said that there was a house on the property in the past, but that he had it demolished.

Mr. Miller said that the Township ordinance requires a 90 foot lot for a four car garage and that Mr. Sowerby’s lot measures only 60 feet.

Mr. Stabile said that the ordinance requires a house on the lake side before a garage can be built on the canal side.

Mr. Sowerby indicated that there are numerous properties along Harbor Drive where a structure is built on the canal side without a home on the lake side.

Ms. Frame indicated that the Township has been trying to correct those types of situations.

Mr. Wilson said that this is a special land use under the provision of detached non-residential buildings. A boat house, garage, or storage structure may be permitted as a free-standing,
non-accessory structure with approval by the commission.

Mr. Leonard indicated that many communities have similar ordinances in effect to prevent the owner of a lot from building a structure such as a pole barn and using it as a residence. He said that the proposed garage is the only use for the property. Additionally, Mr. Leonard stated that the petitioner could have built a garage while the previous home was still in existence and it would not have required special land use approval.

In response to commissioners’ questions, Mr. Sowerby indicated that he would not operate a business out of the garage and that he would agree to a written provision that the garage and the lakefront lot directly across from it would not be sold separately.

Mr. Stabile said that the ordinance was written to keep the lake property and canal property coordinated. To his recollection, the commission has never allowed a garage to be built without a house.

The applicant’s wife, Kata Sowerby, said that the garage would not be an eyesore and would be a positive addition to the neighborhood.

Ms. Frame noted that the commission has to consider the possibility of the parcels being sold separately. She also said that the commission needs to make assumptions in order to protect the Township.

Mr. Sowerby said that the garage would be 20’ x 29’ in size.

When combined with the vacant lot, house, and two canal lots Mr. LaBelle said that the proposed garage at 580 square feet would result in a combined total of 1460 square feet. He said such size exceeds the square footage allowed by the ordinance for garages.

Mr. DeMuynck said that the commission recently passed an ordinance allowing four-car garages providing that the property is at least 90’ wide and has a minimum total of ½ acre.

There were no comments from the public.

Motion by Mr. Miller, supported by Mr. Saelens to close the Public Hearing on Proposed New Garage on a Canal Lot – Special Land Use #2011-05 at 7:54 p.m.

All Ayes Motion Carried

Motion by Mr. Miller, supported by Ms. Frame to table Special Land Use #2011-05 until the next meeting on October 25, 2011 in order for the commission to further investigate the issue.

6. REVIEWS:

A. D.L.H. ROLLFORM, L.L.C. PROPOSED NEW GROUND SIGN – SGN #2011-73: Enio Co., L.L.C., P.O. Box 183220 Shelby Twp., MI 48318. Proposed new ground sign located at 25215 Terra Industrial Drive.

Motion by Ms. Frame, supported by Mr. Miller to approve Sign #2011-73.

All Ayes Motion Carried

B. SCALAWAGS GOLF COURSE PROPOSED OFF-SITE SIGN – SGN #2011-74: Richard Domenick for Scalawags Golf Course 52100 Fairchild, Chesterfield, MI 48051. Proposed
“off-site” sign located at the North West corner of 23 Mile Rd. & Fairchild Road in a former DPW Pump Station, to direct public to Scalawags Golf Course.

Motion by Ms. Frame, supported by Mr. Saelens to deny Sign #2011-74 due to no practical difficulty or hardship reasons.

Ayes: Mr. Miller, Mr. Stabile, Ms. Frame, Mr. LaBelle, Mr. Saelens, Mr. Sciarrino, Mr. DeMuynck
Nays: Mr. Leonard Motion Carried

The applicant, Richard Domenick, gave a brief history of how Scalawags evolved as a private golf club within the Township. He stated that as a result of their recognizable name, membership increased and the business expanded to include a banquet facility that currently hosts about 40-50 parties and 30 golf outings a year; these types of events are often open to the public. Mr. Domenick said that it is difficult for the public to find Scalawags because it sits back from 23 Mile Road. He said that permitting Scalawags signage on 23 Mile Road and Fairchild would be good for business, good for people, and good for traffic, and would improve a pump station. Mr. Domenick stated that he has gotten permission from neighborhood homeowner associations as well as the Township Department of Public Works, but prior to this meeting he was told that this type of signage is not allowed. He asked if there were any kinds of alterations or an appeal he could make. He also asked if the Township might be able to provide him with some signage on 23 Mile Road. Mr. Domenick said he understood the rules, but was hoping to come to an agreement that would not only be advantageous for Scalawags, but would also be an asset to the Township.

Mr. Wilson clarified that the ordinance allows off-site signs, but only in a manufacturing district.

Mr. Domenick reiterated that although they are a private golf club they do host many public functions.
Mr. Saelens pointed out that the sign would be more beneficial to the applicant than the community.

Mr. Leonard stated that it is important to maintain continuity within the community and for that reason there is an ordinance; however, he agreed that the proposed sign would look better than the pump station’s equipment.

Mr. Leonard asked if there were any acknowledgements from DPW of their site visitation.

Ms. Frame said that there has not been any correspondence from the DPW department in regards to this issue.

C. DIAMOND LAUNDRY & CLEANERS PROPOSED NEW WALL SIGN – SGN #2011-75: Daniel Sparby, 9595 Weber Road, Columbus, MI 48063. Proposed new wall sign located at 31275 23 Mile Road.

Motion by Ms. Frame, supported by Mr. LaBelle to approve Sign #2011-75.

All Ayes Motion Carried

D. DIAMOND LAUNDRY & CLEANERS PROPOSED TENANT PANEL – SGN #2011-76:
Daniel Sparby, 9595 Weber Road, Columbus, MI 48063. Proposed new tenant panel
insert in the existing ground sign located at 31275 23 Mile Road.

Motion by Ms. Frame, supported by Mr. LaBelle to approve Sign #2011-76.

All Ayes Motion Carried

E. STEVIE B’S PIZZA BUFFET PROPOSED NEW WALL SIGN – SGN #2011-77: Great
Lakes Electrical & Sign, 13506 Helen St., Detroit, MI 48212. Proposed new wall sign
located at 50670 Waterside Drive.

Motion by Ms. Frame, supported by Mr. DeMuynck to table Sign #2011-77 because it exceeds
the maximum allowed square footage. This would be tabled for up to six meetings, with the
deadline being January 24, 2012.

All Ayes Motion Carried

7. APPROVAL OF MINUTES OF PRIOR MEETINGS:

Motion by Miller, supported by Mr. Saelens to change the minutes from September 27, 2011 to reflect Menards Sign #’s 2011-52 thru 2011-56.

Mr. Saelens said that when the cleaners/beauty salon sign on Jefferson was approved it was stipulated that there would be just one sign on the property; now there are two.

Mr. DeMuynck said that he would talk to Supervisor Lovelock about the matter.
