Proposed MINUTES OF THE REGULAR BOARD MEETING

OF

THE CHARTER TOWNSHIP OF CHESTERFIELD

April 18, 2011

The meeting was called to order by Supervisor Lovelock at 7:00 p.m. in the Charter Township of Chesterfield Municipal Offices at 47275 Sugarbush, Chesterfield, MI 48047.

Present: Supervisor Lovelock, Clerk Uglis, Treasurer Hartman

Trustees: Bell, DeMuynck, Ficht, Printz

Also Present: Deputy Clerk Wurmlinger, Township Attorney Seibert

The meeting was opened with the Pledge of Allegiance

Clerk Uglis read Resolution #2011-06, honoring retired Police Department Lieutenant David G. Marker into the record.

WHEREAS, the Charter Township of Chesterfield has agreed to adopt a Resolution honoring David G. Marker.

WHEREAS, David G. Marker began in career in Detroit in 1971. He left the first precinct in April of 1973 to join the Tactical Mobil Unit which was a specialized strike force unit for the Department until 1976.

WHEREAS, David G. Marker and his family then left Detroit and moved to Chesterfield. Little did he know at that time how his career would take off, when leaving Detroit.

WHEREAS, David G. Marker started his career here in Chesterfield in 1977. He started out as a part time officer. In 1990 he was promoted to rank of Corporal. In 1995 he was promoted to rank of Sergeant. In 1996 then promoted to rank of Lieutenant.

WHEREAS, David G. Marker held the position of Interim Chief of Police on three separate occasions starting in 2001 through 2006. His dedication, commitment and loyalty has brought much joy to him. He loved this Department and everyone respected him.

WHEREAS, DAVID G. MARKER after 33 years of faithful dedicated service to the Chesterfield Township Police Department has decided to retire. We wish him and his family many happy and healthy years of retirement.

NOW THEREFORE BE IT RESOLVED BY the Township Board of the Charter Township of Chesterfield, Macomb County, State of Michigan to pay special honor to DAVID G. MARKER for his loyalty, dedication and many years of contributions to this community on the 18th day of April, 2011.

Trustee Ficht read a proclamation into the record proclaiming May 1, through May 7, 2011 as Municipal Clerks Week.

Whereas, The Office of the Municipal Clerk, a time honored and vital part of local government exists throughout the world, and

Whereas, The Office of the Municipal Clerk is the oldest among public servants, and

Whereas, The Office of the Municipal Clerk provides the professional link between the citizens, the local governing bodies and agencies of government at other levels, and

Whereas, Municipal Clerks have pledged to be ever mindful of their neutrality and impartiality, rendering equal service to all.

Whereas, The Municipal Clerk serves as the information center on functions of local government and community.

Whereas, Municipal Clerks continually strive to improve the administration of the affairs of the Office of the Municipal Clerk through participation in education programs, seminars, workshops and the annual meetings of their state, province, county and international professional organizations.

Whereas, It is most appropriate that we recognize the accomplishments of the Office of the Municipal Clerk.

Now, Therefore, I, Michael Lovelock, Supervisor of the Charter Township of Chesterfield, do recognize the week of May 1 through May 7, 2011, as Municipal Clerks Week, and further extend appreciation to our Municipal Clerk, Janice M. Uglis, and her highly qualified and extraordinarily competent staff, Eric M. Wurmlinger Deputy Clerk, Judi Marker, Christine Hunyady, Linda Ary and Mary Geremesz, as well as to all Municipal Clerks for the vital services they perform and their exemplary dedication to the communities they represent.

Motion by Uglis, seconded by DeMuynck to approve the: 6A) Agenda removing item 6G and placing that as item F under the Regular Agenda. 6B) Approve the minutes of the Regular Board Meeting of April 4, 2011. 6C) Approve the Payment of Bills as submitted by the Finance Department. 6D) Approve Supervisor’s Office request to waive the Entrance and Pavilion fees at Brandenburg Park on June 19, 2011 for participants of the 17th Annual Life Handicap Outdoors fishing outing. 6E) Approve the Lempke-Blackwell V.F.W. Post 7573 requests for Township Board support for the "Buddy Poppies" donation program, at various locations within Chesterfield Township, on May 5, 6, 7, 2011. 6F) Approve the revised date of, Saturday August 13, 2011, for the Anchor Bay Rotary’s use of the Township Municipal Grounds, Senior Center, and restroom facilities for their 3rd Annual Fun Run. 6H) Approve Parks and Recreation Department’s request to print and mail the Spring Program Brochure to all Chesterfield mailing addresses at a cost not to exceed $5,352.00. The lowest quote is from Litho Printing Systems. 6I) Approve DPW’s request to post and hire seasonal employees for 2011 park season at Brandenburg Park; 2 concession employees, 7 booth employees, 2 seasonal park employees, all at an hourly rate of $7.50, and 2 Security guards at $10.00 per hour. 6J) Approve Jeremy and Heather

Nutting at 31094 Blue Heron request for an Easement Encroachment Agreement to permit the encroachment on a public utility easement to construct a pool, subject to and abiding by comments from the DPW and Building Department officials.

Motion by Printz, seconded by Ficht to approve a change to the Township Board Rules of Procedures, Section 7.5 Publication of Minutes adopted November 17, 1997, allowing a brief notice to be published regarding the availability of minutes instead of the actual minutes.

Nays: None MOTION CARRIED

Motion by Printz, seconded by DeMuynck to postpone to May 2, 2011 the Introduction of Ordinance No.135 regarding the specific requirements, duties and responsibilities of the members of the Planning Commission.

Ayes: All

Nays: None MOTION CARRIED

Motion by DeMuynck, seconded by Lovelock to approve Art Van Furniture request for a sidewalk sale permit with a 40’x60’ tent at 50400 Gratiot, Chesterfield, MI 48051 from May 13, 2011 through May 25, 2011.

Ayes: All

Nays: None MOTION CARRIED

Motion by Printz, seconded by Ficht to approve Art Van Furniture request for a sidewalk sale permit with a 40’x60’ tent at 50400 Gratiot, Chesterfield, MI 48051 from August 5, 2011 through August 17, 2011.

Ayes: All

Nays: None MOTION CARRIED

Motion by DeMuynck, seconded by Printz to postpone to May 2, 2011 approval of allowance payment procedure for Police Department Detectives, Patrol Officers and Dispatchers pursuant to their contract and Federal Tax Code.

Ayes: All

Nays: None MOTION CARRIED

Motion by Uglis, seconded by Printz to approve the request from the Clerk’s office to renew the Used Car and Junkyard Licenses for Conigliaro Motors, 46728 Gratiot; Trubiano Motors, 50190 Gratiot; Chesterfield Recycling, 27971 24 Mile Road; and G&T Surplus Resale and Auto Parts, 48475 Gratiot and 54525 Gratiot and to approve the request of Car Country, 49210 Gratiot; Milestone Motors LLC, 48470 Gratiot; and Victory Motors, 29169 23 Mile Road subject

to their business being compliant with the township sign ordinance regarding flags and additional signage such as A-frames and cube truck signage.
