Proposed MINUTES OF THE REGULAR BOARD MEETING

OF

THE CHARTER TOWNSHIP OF CHESTERFIELD

March 15, 2010

The meeting was called to order by Supervisor Lovelock at 7:00 p.m. in the Charter Township of Chesterfield Municipal Offices at 47275 Sugarbush, Chesterfield, MI 48047.

Present: Supervisor Lovelock, Treasurer Hartman

Trustees: Bell, DeMuynck, Ficht, Printz

Also Present: Christine Hunyady, Clerk’s Office, Township Attorney Dloski

Excused: Clerk Uglis

The meeting was opened with the Pledge of Allegiance led by Cub Scout Pack #372, Wolves Den.

Motion by DeMuynck, seconded by Hartman to appoint Trustee Ficht as temporary clerk for tonight’s meeting.

Ayes: All

Nays: None MOTION CARRIED

MOTION TO APPOINT TEMPORARY CLERK

Motion by DeMuynck, seconded by Printz to approve the: 4A) Agenda as submitted. 4B) Approve the minutes of the Regular Board Meeting of March 1, 2010. 4C) Approve the Payment of Bills as submitted by the Finance Department. 4D) Approve Police Department request to purchase three ergonomic intensive use chairs for the dispatchers at a total cost of $2,925.00 from the lowest quote, submitted by Ideal Seating, Inc. 4E) Approve Police Department request to have revisions made to Police Department SOP for Domestic Violence to conform to the protocol of the Macomb County Domestic Violence Council of 2009, and to print same for distribution to all personnel.

Nays: None MOTION CARRIED

Motion by Lovelock, seconded by Ficht to postpone until the April 5, 2010 Board of Trustees meeting the introduction of an amendment to the Garbage Collection and Disposal Ordinance, Section 54-40(2) Billing; Section 54-40(3) Delinquent Accounts; and Section 54-40(4) Payment of Charges and approve for first publication. (Postponed from February 16, 2010)

Nays: None MOTION CARRIED

 

 

Motion by Printz, seconded by Ficht to approve introduction of Ordinance No. 134, Abandoned or Foreclosed Residential Property Registration and Maintenance, and approve for first publication.

Nays: Bell MOTION CARRIED

Motion by DeMuynck, seconded by Hartman to approve the Building Department’s request to adopt Resolution 2010-02 amending the fee for residential, commercial and industrial inspections as it relates to a Certificate of Compliance.

Nays: None MOTION CARRIED

Trustee Ficht as temporary clerk read into the record Resolution 2010-02.

Whereas, the Township Board desires to establish permit, inspection and review fees pursuant to Section 8 of 1972 PA 230 to defray the cost of such enforcement.

NOW THEREFORE, BE IT RESOLVED BY THE TOWNSHIP BOARD OF THE CHARTER TOWNSHIP OF CHESTERFIELD, MACOMB COUNTY, MICHIGAN:

Whereas, a permit fee schedule has been previously adopted by the Charter Township of Chesterfield, Board of Trustees at a regular Board meeting on September 2, 2003.

Whereas, the Building Department is proposing to require a Certificate of Compliance prior to the new owners moving in, and;

Whereas, the Building Department is proposing to amend the fee for this inspection for residential from $125.00 to $250.00 without a bond.

Commercial & Industrial (Includes maximum of two )Inspections $250.00

(Commercial and Industrial bond only) $500.00

Whereas, the purpose of this procedure is to aid in providing decent, safe housing within our community and eventually eliminating blight.

Motion by Printz, seconded by DeMuynck to approve the Building Department’s request to adopt Resolution 2010-03 establishing an inspection checklist for foreclosed property owners to obtain a Certificate of Compliance. (Copy of the Inspection Checklist is available in the Building Department)

Nays: None MOTION CARRIED

 

Tom Dunn, Holli Allen, Joe Miller, Richard Kroll, Thom Yaschen, Barbara Kettler, Robert DeLisle, Linda Megie, Nancy Orewyler, Justin Kroll, and David Papke addressed the Board during Public Comments.

Motion by DeMuynck, seconded by Printz to enter into closed session to consult with the Township Attorney on the Tax Tribunal case, MJC Chesterfield v Township of Chesterfield #327410, pursuant to Section 8(e) of the Open Meetings Act.

Ayes: DeMuynck, Printz, Bell, Hartman, Lovelock, Ficht

Nays: None MOTION CARRIED

Entered Closed session at 7:56 p.m.

Motion by DeMuynck, seconded by Ficht to return to Open Session at 8:17 p.m.

Nays: None MOTION CARRIED

Motion by Hartman, seconded by DeMuynck to authorize the Township Attorney to proceed with an appeal consistent with the discussion held in closed session.
