Proposed MINUTES OF THE REGULAR BOARD MEETING

OF

THE CHARTER TOWNSHIP OF CHESTERFIELD

November 16, 2009

The meeting was called to order by Supervisor Lovelock at 7:00 p.m. in the Charter Township of Chesterfield Municipal Offices at 47275 Sugarbush, Chesterfield, MI 48047.

Present: Supervisor Lovelock, Clerk Uglis, Treasurer Hartman

Trustees: Bell, DeMuynck, Ficht, Printz

Also Present: Deputy Clerk Wurmlinger, Township Attorney Seibert

The meeting was opened with the Pledge of Allegiance.

 

 

PLEDGE OF ALLEGIANCE

Motion by DeMuynck, seconded by Ficht to approve the: 4A) Agenda as submitted. 4B) Approve the minutes of the Regular Board Meeting of November 2, 2009. 4C) Approve the Payment of Bills as submitted by the Finance Department. 4D) Approve Assessing Department’s request to renew annual service and support contract for the Equalizer Assessing System’s software at a cost of $2,450.00, effective November 1, 2009 through November 1, 2010. 4E) Approve Easement Encroachment Agreement for Kenneth N. Dupell, 50027 Oakbrooke Dr. for a permit for encroachment on a public utility easement to construct a garage, subject to and abiding by comments of the DPW and Building Department. 4F) Approve Treasurer’s Department request to renew service agreement with InfoSeal, L.L.C. for the folder/sealer system at a cost of $1,895.00, effective December 23, 2009 through December 22, 2010. 4G) Approve Clerk’s Office recommendation granting 2010 Commercial Garbage and Refuse Collection permit renewals, in accordance with Ordinance #65, Section 5.2 for the following companies: Allied Waste Services/Detroit North, Rizzo Services, Sterling Sanitation, Tringali Sanitation Inc., Veolia Solid Waste Midwest, Waste Management East, and Wasteco Inc.

Motion by Printz, seconded by DeMuynck to adopt Zoning Ordinance #110 amending sections #76-72, Fences in Other Than One-Family Zoning Districts, #76-80, Outdoor Storage, Sales and/or Display Lots, and #76-135, Porches/Terraces, At Grade Patios, Steps/Stairs and Decks and approve for final publication. (Summary: Section #76-72; All fences erected in multiple-family, office, commercial, industrial, and waterfront districts shall require approval by the Planning Commission as part of site plan review. Section #76-80; When permitted in a particular zoning district, an outdoor storage use shall be enclosed by an approved decorative masonry wall or obscuring fence as approved by the Planning Commission. The outdoor display and sales of goods and materials may be permitted after full site plan review and special land use approval by the Planning Commission. The goods and materials shall be clearly accessory to the permitted commercial use that is making the request. #76-135; At-grade patios, porches, terraces or the like must be constructed within the stipulations of required yard space.)

Motion by Printz, seconded by Ficht to adopt Ordinance #133, Administration of State Construction Code and approve for final publication. (Summary: Designating an enforcing agency to discharge the responsibilities of the Township, pursuant to the provisions of the Stille-DeRossett-Hale Single State Construction Code act, MCL 125,1501 et. seq. and repealing all resolutions, ordinances, or parts thereof inconsistent with any of the provisions of this Ordinance.)

Motion by Lovelock, seconded by Uglis adopting Resolution 2009-19, imposing a Property Tax Administration Fee of not more than one (1) percent for eight (8) years. Clerk Uglis read the following resolution into the record:

WHEREAS, the Township of Chesterfield, Macomb County Michigan is responsible for assessing ad valorem property taxes, collecting property tax levies, and handling review and appeal matters arising there from, and

WHEREAS, PA 503 of 1982 provides for imposition of a property tax administration fee (PTAF) of not more than one (1%) percent and,

WHEREAS, it is the desire of this Township Board to approve the imposition of a property tax administration fee as a fee to offset the cost incurred in assessing property values, collecting tax levies and in the review and appeal process.

WHEREAS, the PTAF will be imposed on all tax levies-----winter and summer, including State Education Tax.

WHEREAS, this Resolution shall apply to all property tax levies that shall become due in 2009 or any year thereafter, and this Resolution shall continue in full force and effect until the year 2017.

NOW, THEREFORE, BE IT RESOLVED by the Township Board of Chesterfield Township, that the Charter Township of Chesterfield Board of Trustees does hereby approve and authorize the imposition of a property tax administration fee of 1 percent on all sums voluntarily paid for property taxes before

February 15th of the succeeding year in which the same shall become due and payable and will expire in 2017.

Tom Dunn, Lou Nigro, Joe Miller, Gerald Burak addressed the Board during Public Comments.

Motion by Lovelock, seconded by DeMuynck to adjourn the meeting at 8:38 P.M.
